DLA - late claim (after 65)

Hi all

I suspect this has hit a brick wall but if you have any thoughts please shout.

The DLA claim was submitted late (3 months) by which time the client, who has significant walking difficulties had turned 65. The reason for the lateness was not due to any client error.

DLA claim was unsuccessful on 2 grounds;
- too late for DLA claim as over 65, and
- no entitlement to AA as insufficient care needs.

Decision was appealed and FtT has adjourned today to allow rep to research! Have looked at the SS(C&P) Regs which are not helpful.

As I understand it the welfare rights worker was on extended compassionate leave following bereavement and the client ended up sitting in an in-tray (not literally) until the WR worker returned.
