Morning

This is probably stupid question but I am a bit stuck nonetheless.

Have a couple about to move in together.  He was claiming ESA pending going into prison, she claims IB and gets £108/wk and are going to claim as a couple when he comes out.

My question is can they claim ESA(IB) as a couple?  They will be over the applicable amount without the component and this is where i am stuck, will they be able to make a claim?

Thanks for your help.

Told you it was a silly question.  Yes i guess she can claim IS as a top up to IB.

Thanks

Actually can she still claim IS or would she not need to claim ESA?

They can still claim a top up of Income Support (until she is reassessed)
