Resident Landlord & DHP Application

Hi,

I’m a Housing Options Officer currently dealing with DHP applications. I have a client who has signed a 6 month tenancy agreement for a shared property - she has sole use of a bedroom & living room but shares the kitchen & bathroom with the other tenants. Her weekly rent is £90.00, which is very high for shared accommodation, her HB award is £46.15. The HB Dept are very reluctant to award any DHP because one of the ‘tenants’ she shares with is actually the landlord - she failed to disclose this while completing the DHP form.

Does anyone know of any guidance or case law that would help in these circumstances?

Thanks,

Sorry I should have said that she’s 28 so the newly extended SAR applies anyway. The HB Dept seem adamant to refuse the DHP because the landlord lives at the same property but I can’t see anything in the DHP guidance that suggests they are grounds to refuse.
