DLA and obesity

Hello all

Has anyone had any success arguing for the HRM due to obesity?  My colleague has an appeal coming up - client who has various health problems as well as obesity caused by the HIV meds that she has to take.  I think I remember someone once mentioning about breathlessness due to obesity but is there any case law to support this?

Ali,

Had a gentleman awarded H/M due to Morbidly obese with a BMI 59.

As well as breathing problems from mobilising, back & knee probs were present.

Just before his renewal called in for WCA and guess what?...Yup nil points under activity 1 mobilizing unaided.

Withheld DLA renewal forms until we successfully challenged ESA at appeal; 36 pts awarded, including 15 for 1 (a)(ii) cannot repeatedly mobilise 50 metres etc.

Made a point of flagging it up on the DLA renewal. Still waiting for DLA renewal decision.

Strangely enough, she had her WCA just after the DLA claim went in and also got nul points.  So have got the DLA appeal scheduled for sometime in February and have just lodged the ESa appeal.
