Client withdrew cl. for IB to claim IS refused on the grounds she has deprived herself of income

Assuming circ remain same is it worth putting in repeat claim for IS and how long will it be before a claim is allowed?  They have advised hwer that she should claim again when circ change

Thanks in advance,

Toby Lintern

Was she seeking to obtain IS on the basis of ill-health or for some other reason (lone parent, etc)?

If ill-health I agree with Tony - if not then I’d possibly seek to argue that she wasn’t claiming to be unfit to work due to ill-health and withdrew her IB claim because she didn’t qualify for IB.  Therefore no deprivation.

client wanted to claim IS to get full as opposed to partial help with NHS costs.

She was (is) too sick to work,

Thanks,
