In case helpful -we recently were involved in sending a pre-action letter prior to deadline day that requested cancellation of notice.  The PAP letter and cover email included a clear request that if cancellation could not be confirmed by the requested response deadline (which we fixed before the deadline day in the notice), then interim action was required to extend the notice in the meantime, whilst pre-action correspondence was ongoing & whilst DWP was considering the cancellation. DWP agreed to this and extended the deadline day as an interim measure (while they asked for an extension to respond to the substantive issues raised in the PAP letter).

We had an example of this recently for reasons different from the case discussed here but relying on reg 44(5)(c) on account of cancellation being ‘necessary in the interests of the person’. The PAP resulted in a successful cancellation of the notice.
