Winter fuel payments for peop[e who are/have been in a care home.

Niche area but worth mentioning. It looks as if the .gov website has a mistake about this as it lists Income Support among the benefits that will exclude someone from receiving a winter fuel payment.  . So far as I can see this is not supported by the regs. though if anyone knows different please say.  I suspect very few people who are/were in this situation are still on IS and most would be excluded by the other criteria, but you never know.(See https://www.gov.uk/winter-fuel-payment/eligibility).

I think it’s only saying that you’re excluded if you were in a care home in the relevant period and got IS (or PC, ir ESA or ibJSA)

Think that’s Jane’s point though Daphne. Reg.2 says who can have a WFP, whereas reg.3 deals with those who can’t.

Persons not entitled to a social fund winter fuel payment
3.—(1) Regulation 2 shall not apply in respect of a person who—

(a)is throughout the qualifying week —

(iv)in residential care and is a person to whom state pension credit, an income-based jobseeker’s allowance or an income-related employment and support allowance has been, or falls to be, paid in respect of the qualifying week;

No mention of Income Support for some reason?
