Dependants’ Additions on Carer’s Allowance:- Backdating?.

Does anyone know whether it is possible to get Dependant’s Additions backdated?. I have written on behalf of a client seeking backdating of Dep Addns [which were abolished for new clains from April]. The C.A. Unit have written back refusing this. Are they right to, though, as Dep Addns are not in themselves a benefit, and do not therefore require a seperate claim in the same way that a benefit does. A revision/supersession?. I am not sure whether to appeal, but need to decide to do so quickly if I do. Any thoughts anyone?.

Unfortunately, my technical knowledge of CA isn’t sufficient to directly answer your question.  However, if a separate claim is required, the principles within CP/3447/2003 may assist in terms of what constitutes a claim.  On a similar theme, the “Novitskaya” Court of Appeal judgement may also be relevant.
