CJEU ruling on transfers of undertakings following insolvency
From the Netherlands - C-126/16 - Employees’ rights in the event of transfers of undertakings may be maintained where a ‘pre-pack’ is put into effect following insolvency.

really, this has to be right in the context of the TUPE regs…. TUPE was always going to apply and i’m surprised people thought it wouldn’t (but then, no, i’m not surprised that employers/liquidators try and get round TUPE)
