Overpayment of Discretionary Housing Payments

Client received a Overpayment of DHP for the year of 2015 - 2016

We haven not established the cause of DHP Overpayment from Council as yet as we are in the process of contacting. 

Has anyone come across of the similar case recently

I have dealt with more then a few supposed DHP overpayments over the years and I have always argued that Reg 8(2) of the DFA Regs limits the circumstances in which overpayments may be recovered to those caused by misrepresentation, failure to disclose or error in determining the application for the DHP

Retrospective changes of circumstances such as a backdated HB or other benefit award would not necessarily result in a DHP becoming recoverable
