Can ESA be claimed by young person in follow on foster placement?

Hi

Could anyone advise me?

We have a client who is over 18 in receipt of DLA care and mobility, in FTE and residing in a ‘follow on foster placement’ so the LA are funding their accommodation costs so no tenancy in place.

Client is also paid an allowance by the LA but is it not possible for them to claim ESA in their own right (income-based)?

All advice appreciated.

Hello Liz

There is no restriction on claiming ESA simpy because of being fostered - so can claim in the same way as anyone else

If he is over 18 he is technically not ” in care” With regards to the allowance that SS are giving him, are you aware that payments from SS to care leavers are generally disregarded for benefit purposes but I have had to remind them of that on occasions.

Fair point Jules - I didn’t think the distinction necessary to answer the query although I am sure it’s best to be accurate - certainly here it would be a supported lodgings arrangement
