DLA to PIP

Client was on full DLA received phone call saying will receive a lower rate on PIP but only if client accepts it immediately on the phone. Client asked for something in writing but this was refused. Client felt pressured to accept and did.
Two questions.
1) Has anyone else had this experience?
2) When the award letter arrives do you agree the client still has the right to ask for an MR/appeal?

Entitlement decision still carries right of appeal. So, if unhappy with the award your client has the usual right to request MR and appeal.

Your client could consider making a complaint if he/she has details of the person spoken to on the phone. Could also request transcript of phonecall.

Thank you Benny. I was thinking the same, but the officer’s assertion that the if the client agreed to the award there was no right to challenged is a new one on me so I thought “check it out on the Rightsnet”.

If you have a supportive MP I would also get them involved as this case appears to be Gross Maladministration.
