PIP 104 Week Rule

Hello,

Does anyone know, if there is any case law in place to satisfy the PIP 104 week rule.

I have a carer with a daughter with LD & ASD, who has previously not met the criteria for PIP in a past application and was rejected due to the 104 week rule, as daughter was previously living outside of the UK, living in Ghana.

Is it possible to apply again for PIP prior to the 104 week rule coming to the end? Is there any case law I can use for a PIP application.

As currently carer is unable to access Carers Allowance.
