Hi all,

I just wanted to check if anyone has come across this before. We have a client who receives a war reparation payment from the German government. Is anyone aware what if any disregards apply to this payment?

I understand there is a partial disregard of £10 for “victims of Nazi persecution” but I am unsure if this is what would apply in this case?

Any help is greatly appreciated.

Not dealt with one of these but I have come across this - http://www.legislation.gov.uk/uksi/2001/3481/made (not sure if it is still current)

There is also this from the Rightsnet archives http://www.rightsnet.org.uk/forum-archive/indexc63b.html#1704

The disregard mentioned by Billy is replicated at paragraph 14 of Schedule 5 to the State Pension Credit Regulations, but is for capital.

Your original post suggests this is a regularpayment, i.e. income, and if that is the case, it has to be a prescribed income to be taken into account for Pension Credit. Is it, for example, a pension paid to victims of National Socialist persecution under any special provision made by the Federal Republc of Germany, or any part of it, or the Republic of Austria (regulation 15(5)(b) of the State Pension Credit Regulations)?

Thank you both for the information.

It is indeed as suggested, a regular income.

Reg 15(5)(b) could well be appropriate in this case, I will question the client more and look to use this when applying.

Thanks again.
