Another Past Presence test question for PIP

Brilliant, thank you.  Did you have any luck with the case that you had where the Judge dismissed Art 6 and was retiring the next day?  saw an old rightsnet post I think from last year?

The DWP revised their decision after we applied for permission but on different grounds.

Their PO argued that the advance claim provisions only apply to the disability criteria; I said they applied to all the criteria. But then they revised on that so my client didn’t want to appeal (to her it was about a month’s worth of DLA so wasn’t worth the risk).

Great result for the client once you add in CTC etc but I can’t help but think they did it to avoid a test case.
