Can a client withdraw her ESA claim to protect her right to be paid in future? Client claimed but not enough conts and partner working too many hours. If she just doesn’t return ESA50 she will be found not to have LCW which could jeopardise a future claim. If she withdraws the claim instead, would it enable her to be paid ESA if she ever has to claim in the future or would a withdrawal still be classed as not having LCW and therefore not entitled to be paid?
