Just wondered if there is ever a way around ESA reg 106 (3) which says that if you defer an occupational pension aged 60+ you are treated as if you are receiving it?

Client turns 60 in May and will get approx. £40 p/w pension. If she was able to defer it there is a possibility it may be a bit higher when she reaches retirement age in 2021, an option she is keen to explore. However, it looks to me like this won’t be possible without reducing her ESA.

Is there an equivalent rule in HB?

She gets IR ESA/HB/CTR and (for completeness) she also does supported permitted work.
