Just flagging this up in case it is the start of a trend.

A client recently succeed with a (very straightforward) WCA appeal (client had 9 points already- tribunal awarded further 6 on sitting/standing- clearly supported by the evidence- and client placed in WRAG as we anticipated) but client has now received template letter from DWP to the effect that they have requested the SOR and will continue to pay the assessment phase rate whilst they await this/decide whether to seek leave to appeal to the UT.

Whilst this was happening all the time with PIP appeals for a while I honestly can’t remember the last time this happened to one of my clients with an ESA appeal (possibly never actually) and I am a little concerned this may mark the shape of things to come. I shall see whether it starts to happen regularly and if anyone else notices similar I would be most interested.

Not that I’ve noticed. Perhaps you got (un)lucky. Is it one single case?

Thanks Edmund. I very much hope that’s the case. Probably my paranoia knows no bounds.

Have a good weekend all.
