Man recon and court case

Anyone came across a case were prosecution was lodged for failing to report a change in circumstances and the decision being changed at the mandatory reconsideration stage?
Not that this has happened to my knowledge , but it makes me wonder how would this affect the court case if the department did indeed change the decision and would they even make such a favorable decision regardless of the further evidence provided for fear of contradicting another department?
