Hello, hopefully a easy question, does any one know if the Fife cases UT decision over ruling the arguments on room size is going to the higher Courts ?, any information gratefully accepted.

Hi Neil, I am not aware of any appeal but will try to find out.  However, did I misread you - did you mean to say that it overrules size arguments?  It does allow size to be an argument, but you have to establish that the size, shape, etc makes it unreasonable for someone to use as a bedroom.  We have had successful FTT decisions since, where the judges follow the Fife decisions. I was trying to be brief in by request, I appreciate the ruling doesn’t totally rule the arguments out but in my case it does , and I was wondering if it was worth pressing on in the hope the higher courts, over rule it.
