JSA and the disability premium

I think I may be missing something really obvious and would prefer to not turn up to Tribunal and look like an idiot if i have…..

I am helping a couple with an appeal for JSA.

Couple, he is claiming IB and Industrial Injuries Benefit.  She was claiming JSA (C) and when this expired she claimed JSA (IB) and was turned down.  Refused on basis of excess income but this is because they have not included the disability premium.

Now as far as I can tell they are entitled to the disability premium on the basis that he is in receipt of long term IB.  Submission from DWP makes no mention of DP.

Should they be getting it?  If so which reg does this come under?
