Effect of live in carer on benefits

A client has been awarded NHS Continuing Care to delivered in her own home via a live in carer.  The daughter has been told that she will have to contribute 2hrs of caring every day to support Mums care plan, which she will find difficult with a young family.  The alternative is to send a 65yr old into a care home with people much older.  The daughter fears for Mums mental health should this happen, so feels blackmailed by the situation.

DWP has also told her that Mums pension credit claim will stop because she will be classed as living with someone even though they are a live in carer (I assume this is just the SDA they are referring to)

DWP are also talking about her losing her DLA because she will be receiving NHS CHC.

Any advice on this?

She won’t lose her DLA if she continues to live in her own home and receives CHC; this would be different were she to go into a care home.

CPAG p.235-236 for the SDP bit (it depends on exact living arrangements, etc.)
