I repped on my first PIP tribunal yesterday - successful outcome with and award of the standard rate for both components.

In our area ATOS do the medicals for these claims.

The client is suffering unstable bi polar disorder, very marked obsessive compulsive disorder and ADHD.

Guess what - the ATOS medical assessor was a physiotherapist, who’s mental health assessment was wholly inadequate.

Have they or the DWP not learnt anything following the highly critical UT decisions in CE/3883/2012 and CE/2527/2013.

We also sent in very relevant medical evidence from the client’s consultant psychiatrist months before the appeal was heard.

Steve, be warned, if our experience is anything to go by the DWP will request the SOR and refuse to pay whilst SOR is being produced.

But yes- I agree with you. It is all feeling very de ja vu.
