Question about the date used for three months backdating - over pension age

Council are saying the three months goes from the date they received the completed form, whereas I thought they should use the issue date stamped on the form. Form was returned well within the one month period.

Are the council correct?

The council should use the issue date stamped on the form if it was received within one month of that date and so long as your client qualified for HB for that entire period.

Refer them to the Shelter guide page 70/71 (2013/14 ed) or Page 128/129 of the CPAG handbook 2014/15 ed

You could also ask council why they are bothering to stamp an issue date on forms if they’re not going to take any notice of them.

Maybe try that after getting them to change their minds….....
