I seem to remember a poster in our local venues saying that it was illegal for anyone to act as rep for a fee unless that person was qualified or authorised to do so. Unfortunately it did not go into any details about what qualifications or authorisations would be needed. Has anyone got any ideas, and especially what specific legislation is referred to.

I’ve never heard of one.

By nature the Tribunal is meant to be flexible, fair and just.

Rule 11(1)(a) of Tribunal Rules (Social Entitlement Chamber) 2008
Allows for representatives “whether a legal representative or not” to be allowed to represent.

I think this was a measure by the Tribunal to get rid of unregulated persons not accountable to anyone to give representation.

I would write to Administration Centre and make further enquiries and if they persist to seek qualification then maybe seek to place this on a Tribunal Users Group (TUG) agenda.

Commissioner Jacobs did not find any problems with paid-for representation in CDLA 1465 2005.

Thanks, I think I will write to the Tribunal Service in the first instance.
