Housing benefit payment and Occupational charges

Dear Colleagues

Housing benefit has been decided to be paid but I would appreciate if you let me know how

your local authority deal with those payments.

Is there any regulation or guidance that you are aware of it?

Hi Gareth

We have means profit accounts and its was agreed in the past that MPA should be set in

occupants name in order to receive housing benefit payment.

Normally we get those payment via succession cases but at the present looking for the

easier solution ie. direct payment to the client.

I am searching to see if there is Regualtion or Guidance related to this issue.

If anyone has any inditication please call me and let me know.

Do you mean Mesne profits? These count as rent for HB: reg 12 (1)(c) HB Regs 2006

Is there a part that is related how Mesne HB could be paid or just to follow housing benefit pyaments rules?

I don’t think there are any special provisions for payment of HB for Mesne profits. It qualifies because it is in the definition in reg 12 and seems to be just subject to the usual provisions governing payment etc

A person succeeding to a tenancy will not inherit any debt that the former tenant may have accrued.  This was confirmed by the Court of Appeal in Notting Hill Housing Trust v Jones 20 January 1999.

You cannot pay housing benefit into the former tenant’s acount when that benefit is in respect of another person’s entitlement and is also in respect of a period after the former tenant ceased to be liable

Dear Colleagues

I would like to inform you that I received HB backdating since 2009 amounting

£22.000 and at the moment trying to obtain £4000 via DHP to cover the outstanding

rent arrears.
