Increase of DLA on renewal not coming into force until current DLA award runs out

Hi

My client’s DLA has increased on renewal from lowest rate care to higher rate mobility and middle rate care.  However, this increase will not come into force for another month when her current DLA award runs out.  Is there any way to challenge this.  If so, would there be any risk involved?

It depends when the change in circumstances occurred.

The client is a bit vague on this.  She has said that her condition has gradually become worse.

As long as the 3 month qualifying period has been established she can always appeal arguing that the renewal claim should have been treated as a supersession request.  There is always a risk.
