Can DLA be stopped so obliged to apply for PIP?

Hi all,

I have a client who is 16 due to turn 16 November in reciept of DLA MRC - award is until May 2014. She has been sent PIP forms to fill in and been told should she not fill in the PIP form then her DLA claim will be suspended however they will give her the benefit of a month and will stop the claim in December.

I wanted to know what would happen if client did not claim PIP? Can the DLA claim be suspended from December as she will turn 16?

Can someone shed some light, thanks in advance.

Yes a DLA claim stops at a person’s 16th birthday now, regardless of when it was originally made to.

If she doesn’t claim PIP DLA will stop regardless; it probably will anyway if my recollection of teh regs is good.

This is covered by regulations 9-11 of The Personal Independence Payment (Transitional Provisions) Regulations 2013 and the claimant must be given a second chance.
