DLA Appeal - SoS Submission incomplete

Looking for case law with regards to a direction issued by FtT in connection with a DLA appeal - requested an postponement and also a copy of the claimant’s previous DLA claim.
FtT agreed to postponement, but in the directions they state that did not consider that the DWP should be requested to provide a copy of the previous application?

Have written & faxed previously to DWP with no reply?
Judge Wright’s decisions with regards to missing paperwork in ESA/IB cases speaks about breach of human rights, is there a similar decision for DLA?
