Exemptions for ‘bedroom tax’

We have a situation where a single tenant in a three bedroomed property is losing 14% of her housing benefit due to having one spare room. The lady in question requires a lot of care and has two carers resident as one could not cope with lifting her and the hoist. Housing benefit have made one room exempt as they have said “one claimant one spare room” meaning that the two carers would be expected to share.
DHP payments were awarded for a short time but have now been disallowed.
I would be interested to hear if anyone has come accross a similar situation and what the local authority response was

The LA response would be that Reg B13(6) allows one extra bedroom where the claimant or partner, or both, is/are a person who requires overnight care.  If either of the carers actually lives there it’s a different matter - they count as occupiers and a room is allowed for each occupier.  But if the carers don’t live there, it doesn’t matter how many there are or whether there is more than one in attendance on the same night - the Regs only allow one room per claim.
