Incontinence during seizure type episodes

Client has a brain cyst. Has seizure type episodes during which she can have bladder incontinence.

Examining practitioner has ignored this within the WCA as “incontinence during seizures not relevant” .

Are there any case law decisions against this approach?????

[Satisfies the WCA but in WRAG….have appealed with view to Support group. Looking to Reg 35 but also think she satisfies Descriptor 8 in sched 3]

When was the assessment? Descriptor 8 changed on 28th January, to say ‘Absence or loss of control whilst conscious ...’.
