CTS and permanent residential care
We have the default scheme here. I have a client whose husband was admitted to permanent residential care on 1 July. He is on s117 funding. She made an application for CT Support and they are taking his occupational pension into account in the same way as they would if it was a “normal” couple claim. There are no formal or legal arragements for her to be paid part of this pension. It is paid into a joint account. If it was still CTB they would be treated as single claimants. I assumed this would be the same under the default scheme. But I can’t find any reference to it in the regulations.
Am I just not looking properly or has this useful provision been omitted from the default scheme?
