Good Morning

I have had a call from a potential client who has an appeal hearing on 30th August 2013 (10 days) and i need somee urgent guidance.

Issue is clear, client was in receipt of low HRM and MRC from 2006 - April 11th 2011. Completed renewal forms October 2010 and medical report sent to DWP in February 2011.

Based upon this DWP decision made March 2011 - reduced award to HRM & LRC from 12th April 2011-3rd April 2013.

Client received this award until renewal forms completed in November 2012.

DWP decsion January 2013 -  confirmed HRM and LRC. Client rang them to ask why decsion had been reduced from MRC to LRC (client apparently never received notification of reduced amount in 2011 and never noticed reduced amount for the period April 2011 - January 2013!).

Client had January 2013 decsion revised in March 2013 and MRC awarded from 29th November 2012 for an indefinate period.

Client is now appealling the period 12th April 2011 -28th November 2012. My question is:

As clients appeal for this period was only made in January 2013, 22 months after original decsion (March 2011), do grounds even exist for an appeal?

Certainly looks as if it is outside of time limits… Perhaps it was accepted that valid decision notice notifying right of appeal etc. not issued?

Would be interesting to see appeal papers.
