Under the old HB scheme, private tenants do not have their rent restricted for the first months if they could afford the rent before they claimed housing benefit.

Is there any similar protection against the rent restriction under LHA?

The claimant is not working. Now receiving both ESA and HB/LHA but only claimed very recently for the first time.

Yes, this protection applies to any rent restriction regime: exempt accommodation, LRR/CRR, LHA and now bedroom tax as well.
