Single Dutch national 61 yrs old, came to Uk Nov 2004, claimed JSA until got job 3/9/2007 to 6/10/2010 and claimed JSA 14/2/11 to 1/13. Claimed PC 1/13 refused decision states - as lost worker status so no right to reside and not habitually resident as per Immigration (EEA) regs 2006 Reg 2(1) (2) (3)
Was looking at 5 yr rule for people with a permanent right of residence - since 30 April 2006, would periods as jobseeker count?  Or only if he had been self sufficient which he wasn’t as he claimed JSA?
Could he claim ESA instead?

Any help appreciated as this area is new to me.

The difficulty is the period from October 2010 to February 2011.  On the info provided it would seem that DWP took the view he left the job market and enjoyed no R2R in particular before re-entering the job market as a work seeker again.  The link with the past period of employment seems to have been broken.

Do you know what he was doing in those months and where he was doing it?
