Court of Appeal grants permission to appeal against High Court judgment in Nicholas v SSWP
Thanks to Desmond Rutledge of Garden Court Chambers for alerting us to the Court of Appeal’s grant of permission to appeal against the High Court’s decision - in Nicholas v SSWP - that the claimant had had a fair hearing of her incapacity benefit appeal despite the omission of previous personal capability assessment reports from the tribunal papers.
