New Lord Chancellor’s Guidance on Civil Legal Aid and Exceptional Funding, both applicable from 1st April 2013, has been issued, based on Legal Aid, Sentencing and Punishment of Offenders Act 2012.

You can also find supplementary guidance on the domestic violence requirements set out in the Civil Legal Aid (Procedure) Regulations 2012, which takes effect from 1st April 2013.

The first piece of guidance determines whether an applicant qualifies for civil legal services. This guidance refers to certain statutory instruments, which are still subject to Parliamentary approval. This other guidance issued by the Lord Chancellor to the Director of Legal Aid Casework determines whether civil legal services are to be made available when considering an application for exceptional funding.

- the Civil Legal Aid (Financial Resources and Payment for Services) Regulations 2013 .... that set out the rules for making a determination about whether an individual is financially eligible for civil legal services under the Legal Aid, Sentencing and Punishment of Offenders Act 2012 and set out when an individual is required to pay a contribution in respect of the cost of the civil legal services.
