ESA Appeal, Right to Reside and claiming JSA
Claimant was refused ESA due to no right to reside.
She claimed JSA pending outcome of tribunal.
Tribunal found she did have RtR but ESA are refusing to pay as she was (and still is claiming) JSA.
DWP are stating that she needs to make a fresh claim for ESA with a new RtR decision (I can see this going round in circles).
As this was not a work capability assessment there appears to be no prescribed mechanism to revise the JSA.
Any help appreciated
