Section 71of The Tribunals, Courts and Enforcement Act 2007 allows for the common law right to distrain for arrears of rent to be abolished but that, as far as I’m aware, has not yet been brought into force.  However, even that does not go far enough in my view.  The archaic common law power to distrain for “rent or other money due” should, in all but the commercial sector, be abolished altogether.
