I wanted to ask anyone if there will be any changes in the rules for claiming IS due to being treated as incapable for work under the PCA of Incapacity Benefit (you couldn’t get IB because you have not made enough NI contributions) prior to Oct 2008.
As you were able to keep your IS, if you had made a claim before Oct 2008, - will this change when all those on IB are being migrated to ESA? And if so when will it happen?
Does the ESA migration mean that these IS claimants will simply move over to income related ESA? (well, depending if they pass the WCA) . Also does it mean that people can continue to claim IS in lieu of Incapacity until they are moved on to ESA even though it may not happen for some people until 2012, 13 or 14?

Just interested to know as I doing a training session on IS and wanted to clarify the categories were IS can be claimed.

People getting IS on the grounds of incapacity will be migrated to ESA in exactly the same way as those getting incapacity benefit - migration will be at the time they would have been reassesssed under the PCA and their payment will continue seamlessly if they are migrated over.
