Two homes payment for a disabled person

Hi,

My client is severely disabled. He is in the latter stages of Myelofibrosis and classed as terminally ill.  He lives with his daughter who is his full time carer.

They moved council tenancies on the grounds of disability.  However, there was a two week delay in moving into the new tenancy as it had to be prepared for my client. As a result, HB was only paid form the date they moved in.

I am trying to obtain a two homes payment on the grounds that the property was being adapted to suit the needs of a disabled person. However, the problem is that none of the adaptations were to the ‘fabric or structure’ of the property.

Due to my client’s condition the property needed to be fully cleaned, carpeted and wall papered.  This was to prevent any infection caused by dust or bacteria.  He has practically no immune system and is very prone to infections.

If anyone has any experience with this regulation or has any advice I would be grateful.
