Hmmmmm ...

Hi all !
Have a cl who has claimed HB and has shared custody of his 2 children after an order was made by the court.
He has claimed HB but the LA has refused to include the child whom he receives CB for in the calculation in his weekly appl. amount.
For this reason he is getting less HB as LA is treating him as a single claimant.
Reg 20 of HB legislation appears to clearly state that a person shall be treated as being responsible for HB purposes if they receive CB for them.
LA appear to have based their decision on the basis that the mother of the child has more responsiblities for child, even though cl receives CB for them, ie : they are registered with GP near her and the school is closer to hers but I feel this is irrelevant as to whether child should be included in cl HB calculation or not.
Sorry if this makes little sense but any thoughts etc ...
