Zambrano, certificate of employment and recourse to public funds?

Hello

I have a client who has submitted an application for leave to remain in the UK under the Zambrano ruling. As this EU judgment has not yet been incorporated into the immigration rules, the client has been issued with a ‘certificate of employment’ stating that she has the right to work while she waits for the immigration application to be processed.

No Home Office letters mention benefits and nothing says that she does or doesn’t have recourse to public funds while she waits.

The client has made a homelessness application, and is receiving HB and CTB, so the local authority (Lewisham) has apparently decided that she has recourse to public funds.

Should I advise her to make benefit applications?
