UT procedural irregularity

Have been refused leave to appeal by UT Judge. In their decision they have explained their reasoning but this includes the same error I tried to highlight in the application for leave to appeal!
Could this meet 43 (2)(d) Procedural irregularity: UT Rules 2008 Setting aside a decision?

You don’t say what the procedural irregularity was, but it would need to be highly significant as tribunal judges have a lot of leeway in how they choose to run their tribunals, and also you would need to have a good chance of success with your case.  See the Case Management Powers in the 2008 First Tier Tribunals Regs http://www.justice.gov.uk/downloads/tribunals/general/consolidated-tp-ftt-sec-rules2008-6-4-12.DOC
