My client failed the WCA and her ESA has been stopped. During the run-up to the appeal her partner moved in and they made ajoint claim for JSA. This has now been refused on the grounds that my client is claiming ESA.
As they live together individual claims aren’t appropriate.
Which benefits should they claim?
