Hello,

If a Tribunal decision reinstates a claimant’s DLA that qualifies them for Carers Allowance, should the claimant’s CA get automatically reinstated after the Tribunal Service have informed the DWP of the decision to reinstate their claim for DLA (Middle Care)?

Thank you

A further claim for CA must be made within 3 months of the decision to reinstate the ‘qualifying benefit’ - DLA middle care - for the CA to be backdated to the date the earlier claim ended in accordance with Reg 6 (19),(20), (21) Social Security (Claims and Payments) Regs.
