JCP tactics for supersession requests & time-limiting

Just had sight of a letter from JCP to client requesting supersession to the support group made prior (conicidentally) to exahaustion of ESA(C).

This looks like a standard letter designed to deal with (I guess) an averlanche of similar requests to ameliorate the loss of ESA(C).

Client sent in supporting evidence to indicate worsening condition (not see this though), but JCP are asking client to clarify sepecfic date of deterioration (difficult for MH) and evidence for the reason. If unable to do this they are suggesting they will treat the request as an application for a late appeal instead. ‘Failure to respond within 14 days will result in application to the Tribunal Service for late appeal’.

The moral of the story is that clients/advisers will need to be very clear on a supersession requests about what the deterioation is and the date, otherwise be prepared for a letter
