Does anyone know of any UT decisions that might help me out here? I’ve got an 18 year old care leaver, placed by the local authority in Supported Accommodation with her former foster carers.  HB have refused on non-commerciality, simply because the rent charged is the same as the 1bed self contained rate, to which the client is entitled as a care leaver.  Social Services are paying towards the client’s care & support but the basic contractual rent has been set at 1 bed self contained, as agreed for all supported lodgings cases in the borough. This is the only one they’ve argued, and there’s no other reason for the non-commerciality/contrivance decision.

(And yes, it’s the same LA that placed her and are now refusing to pay benefit)
