Carer’s Allowance, loss of dependent addition
Man is a carer and gets CA plus dependent addition, until 2010 when an incorrect decision is made to terminate the qualifying award of his partner’s DLA. On appeal, DLA is reinstated, so man claims his CA again. Except the CA unit call this a new claim, rather than revising the decision to stop the previous claim. On this basis, he loses his dependent addition, as can no longer be paid on a new claim.
We are currently appealing the decision with man.
Does anyone have any useful ideas how to persuade the tribunal that the claim for CA is definitely not a new claim, but a request to revise the previous decision to refuse? Even better, a UT decision.
