All advice appreciated….....our client began caring for their disabled parent in November 2011, contacted DWP to request AA claim but form apparently not issued until early December 2011 so IS claim has been refused from mid November.

Client has medical evidence supporting the fact they are carer, can we challenge IS decision and request backdating to November?

You could appeal against the IS decision, whilst you wait for the AA decision to come though? 

Then when the AA is awarded you can ask the DWP to revise the decision under the Relevant Benefit Rule. Although any IS awarded will only be paid from the date the AA is awarded. I think this is right?
